Valley Forge Rd, King of Prussia, PA, will hold a public hearing on and after will consider and take action on the following proposed ordinance summarized as follows: Upper Merion Township ORDINANCE NO. 2026- (summary) AN ORDINANCE OF THE TOWNSHIP OF UPPER MERION, MONTGOMERY COUNTY, PENNSYLVANIA AMENDING CHAPTER 165, ZONING, SECTION 165-5, WORD USAGE, DEFINITIONS, TO ADD DEFINITIONS RELATED TO DATA CENTERS; AMENDING CHAPTER 165, XXVIII, OFF-STREET PARKING AND LOADING, TO ADD A NEW MINIMUM PARKING REQUIREMENT; AMENDING CHAPTER 165, XXXI GENERAL REGULATIONS TO ADD A SECTION FOR DATA CENTER CONDITIONAL USE REQUIREMENTS; AMENDING USE REGULATIONS IN CHAPTER 165 FOR LIMITED INDUSTRIAL, HEAVY INDUSTRIAL, AND SUBURBAN METROPOLITAN 1 ZONING DISTRICTS TO PERMIT DATA CENTERS Section 1. Amends Chapter 165, as follows: A. Section 165-165-5 Word usage, Definitions, to add definitions for data center, acoustical barrier and mechanical equipment. B. Section 165-191. B.5 Off-street Parking and Loading, adding new subsection (f) providing parking requirements for data centers C. Section 165-191.11 General Regulations, adding new section (11) establish conditional use requirements for data centers in the SM-1, LI & HI District. D. Section 165-144 Use regulations, adding new subsection (K) permitting data centers in the LI District by conditional use. E. Section 165-153, Use regulations, adding new subsection (I) permitting data centers in the HI District by conditional use. F. Section 165-216.E Noise Performance Standards, adding new subsection (12) providing regulation of backup emergency generators. G. Section 165-135, Use Regulations, adding new subsection (Q) permitting data centers in the SM-1 district by conditional use. Section 2. Provides for a repealer clause Section 3. Provides for a revision date Section 4. Provides for a severability provision Section 5. Provides for an effective date. Section 6. Provides for a Failure to Enforce provision.
