TREDYFFRIN TOWNSHIP NOTICE ORDINANCE NO. HR–496 NOTICE IS HEREBY GIVEN that the Board of Supervisors of Tredyffrin Township will hold a hearing at a regular meeting to be held on Wednesday, May 20, 2026, commencing at 7:00 p.m., prevailing time, at the Township Building, 1100 Duportail Road, Berwyn, PA to consider enacting an ordinance amending the Home Rule Charter for the Township of Tredyffrin, a caption and summary of which follows. The complete text of the ordinance can be examined without charge or obtained for a charge not greater than the cost thereof at the Township office or on the website at www.tredyffrin.org. AN ORDINANCE AMENDING THE HOME RULE CHARTER FOR THE TOWNSHIP OF TREDYFFRIN. SECTIONS 1, 2. Amends Article I, Name and Powers, §102, General powers, and §105, Powers vested in the Board of Supervisors, to revise the references to Tredyffrin Township and the Commonwealth of Pennsylvania. SECTION 3.Amends Article II, Township Board of Supervisors, §202, Term of office, to delete reference to the term for the first Board to serve under the Charter. SECTION 4.Amends Article II, Township Board of Supervisors, §203, Qualifications, to revise all references to gender-neutral pronouns. SECTIONS 5, 6, 7. Amends Article II, Township Board of Supervisors, §205, Vacancies, Subparagraph B and Subparagraph C (1) to revise the references to the Commonwealth of Pennsylvania; and to revise all references to gender-neutral pronouns; amends Subparagraph C (3) to replace the phrase “qualified electors” with the phrase “registered voters.” SECTION 8. Amends Article II, Township Board of Supervisors, §207, Establishment of districts, Subparagraph A, to revise all references to gender-neutral pronouns. SECTION 9. Amends Article II, Township Board of Supervisors, §208, Compensation of Supervisors, Subparagraph A, to revise the compensation rate; and deletes reference to compensation for the first four years of the Charter’s establishment. SECTION 10. Amends Article II, Township Board of Supervisors, §209, Board organization, to revise all references to “Chairman” to be gender-neutral. SECTIONS 11, 12, 13. Amends Article II, Township Board of Supervisors, §210, Board meetings and procedures, Subparagraph B to revise all references to “Chairman” to be gender-neutral; amends Subparagraph C to update the requirements for the establishment of a quorum of the Board to include electronic means; revises Subparagraph D, setting forth the procedures for official actions by the Board; and renumbers the existing Subparagraph D as Subparagraph E. SECTION 14, 15. Amends Article II, Township Board of Supervisors, §211, Records and reports, Subparagraph A, to delete the phrase “at a reasonable cost”; and Subparagraph C to state that the agenda shall be available at least twenty-four hours prior to the start of the Board meeting. SECTION 16. Amends Article II, Township Board of Supervisors, §212, Legislative duties and responsibilities, to require the Board to amend as necessary the adopted Administrative Code; to revise the references to the Commonwealth of Pennsylvania; and to revise the manner in which the Board shall initiate inquiries and investigations in aid of its legislative functions. SECTIONS 17, 18, 19. Amends Article III, Elected Auditor, to delete §§302, 303, 304, 305 and 306 in their entireties; revises the title of Article III to “Audit”; and amends §301, Elected Auditor, to be titled “Annual Independent Audit,” and requires an independent annual audit by a Pennsylvania Certified Public Accountant or firm. SECTIONS 20, 21. Amends Article IV, Elected Tax Collector, to delete the Article in its entirety; and renumbers Articles V through XI as Articles IV through X, respectively. SECTION 22. Amends Article IV, Township Manager, to revise all references to gender-neutral pronouns; and deletes the Township residency requirement to be Manager. SECTIONS 23, 24, 25. Amends Article V, Ordinances, §501, Actions requiring Ordinances, to update the enumerated powers and duties of the Board which shall be exercised by ordinance; deletes Subparagraphs F and G in their entirety; renumbers Subparagraphs H and I as Subparagraphs F and G, respectively; and revises Subparagraph G to add the phrase “land development ordinance.” SECTIONS 26, 27, 28, 29. Amends Article V, Ordinances, §503, Procedure for enactment, to update the procedures for introduction, advertisement and enactment of an ordinance. SECTIONS 30, 31, 32, 33, 34. Amends Article V, Ordinances, §504, Emergency Ordinances, to delete the section in its entirety; amends §505, Standard codes of technical regulations, to be renumbered as §504, and deletes the phrase “and for purchase at a reasonable price fixed by the Board”; amends §506, Recording, to be renumbered as §505; amends §507, Compilation, to be renumbered as §506, which sets forth requirements for a compilation of all Township ordinances; and amends §508, Amendments, to be renumbered as §507. SECTION 35. Amends Article VI, Township Administration, §601, General provisions, to clarify actions of the Board are consistent with the Charter or general law; and deletes reference to changes to the Administrative Code. SECTION 36. Amends Article VI, Township Administration, §602, Personnel system, regarding the administration of the Township’s personnel system, in accordance with the Administrative Code and the applicable collective bargaining agreement for police officers. SECTION 37. Amends Article VI, Township Administration, §603, Township Solicitor, to revise all references to gender-neutral pronouns; and to reflect that a law firm is appointed as Township Solicitor, not an individual attorney. SECTION 38. Amends Article VI, Township Administration, §604, Superintendent of Police, to revise all references to gender-neutral pronouns; and to delete the Township residency requirement for the position. SECTION 39. Amends Article VI, Township Administration, §606, Finance Director, to revise all references to gender-neutral pronouns; deletes the requirement for the Township Manager to be responsible for the duties of the Finance Director since one is now appointed; and provides that the Finance Director shall serve as the chief financial officer to Township officers, departments, boards and agencies. SECTIONS 40, 41. Amends Article VII, Financial Administration, §701, Fiscal year, to delete the phrase “after 1976”; amends §702, Classification of accounts, to revise the reference to Article VIII to be Article VII. SECTION 42, 43, 44, 45. Amends Article VII, Financial Administration, §704, Operating budget, Subparagraph A(1), to delete the phrase “Personal services” and replace it with “Personnel expenses”; amends Subparagraphs B and C regarding the procedure for public inspection and advertising of the preliminary budget and the adoption of the final budget; and amends Subparagraphs D and E regarding the amendment of the budget by resolution. SECTION 46. Amends Article VII, Financial Administration, §705, Capital program and capital budget, to be consistent with the Administrative Code for capital expenditures. SECTIONS 47, 48, 49. Amends Article VII, Financial Administration, §707, Contracts, Subparagraph B, to require that contract amount limits be set by resolution of the Board; amends Subparagraph C, to revise the requirement for advertising for competitive bidding to one newspaper; and amends Subparagraph C(2) to incorporate contract amount limitations set by state law. SECTIONS 50, 51. Amends Article VII, Financial Administration, §708, Disbursements, to revise all references to gender-neutral pronouns; and amends §712, Financial limitations, Subparagraph B, regarding the citation to the Local Government Unit Debt Act. SECTION 52. Amends Article VIII, Prohibited Activities and Conflict of Interest, §801, Prohibited activities, to revise all references to gender-neutral pronouns and to enumerate additional bases upon which discrimination is prohibited. SECTIONS 53, 54. Amends Article VIII, Prohibited Activities and Conflict of Interest, §802, Conflict of interest, Subparagraph A(1), to revise all references to gender-neutral pronouns; and amends Subparagraph C, to exclude principal residences from required statements of real property ownership by the Board. SECTION 55. Amends Article VIII, Prohibited Activities and Conflict of Interest, §803, Violation, to revise all references to “Chairman” to be gender-neutral and to replace all references to the term “electors” with the term “voters.” SECTION 56. Amends Article IX, Citizen Participation, §901, General provisions, Subparagraph A, to revise all references to gender-neutral pronouns, and clarifies that service on a board, commission, authority, committee or agency shall be by appointment of the Board. SECTIONS 57, 58, 59, 60, 61. Amends Article IX, Citizen Participation, §902, Initiative and referendum, to replace the term “electors” with the term “voters”; revises all references to gender-neutral pronouns; and revises all references to “Chairman” to be gender-neutral. SECTION 62, 63. Amends Article X, General Provisions, §1002, Gender, to delete the section in its entirety; and amends §1003, Amendment, to be renumbered as §1002. SECTION 64. Amends Article X, General Provisions, §1004, Effective date, to be renumbered as §1003 and to leave open the effective date of the Charter unless and until approved by the electorate. SECTION 65. Amends Article X, General Provisions, to add new §1004, Elected Auditor, which sets forth the term of the elected auditor pending adoption of the Charter. SECTION 66, 67. Amends Article X, General Provisions, to add new §1005, Departments, offices, agencies, boards and commissions, to delete references to initial adoption of the Administrative Code; and amends Article XII, Transitional Provisions, to delete the section in its entirety. SECTION 68. Provides for the severability of unconstitutional or invalid provision of the ordinance. SECTION 69. Repeals ordinances or parts of ordinances in conflict with any provision of this ordinance. SECTION 70. Provides that the ordinance shall be effective thirty-one (31) days following adoption.
