PUBLIC NOTICE UPPER DARBY TOWNSHIP Notice is hereby given pursuant to the Local Tax Enabling Act that at its regularly scheduled meeting on Wednesday, September 17, 2025 at 7:00 p.m., to be held in Meeting Room #202 of the Municipal Building, 100 Garrett Road, Upper Darby, Pennsylvania, Upper Darby Township Council will hold a public hearing, and if appropriate, enact an ordinance, the title and summary of which appear below: ORDINANCE No. 3191 AN ORDINANCE OF UPPER DARBY TOWNSHIP, DELAWARE COUNTY, PENNSYLVANIA IMPOSING A TAX FOR GENERAL REVENUE PURPOSES ON EARNED INCOME AND NET PROFITS OF RESIDENTS OF UPPER DARBY TOWNSHIP, DELAWARE COUNTY, PENNSYLVANIA AND ON EARNED INCOME AND NET PROFITS BY NONRESIDENTS OF UPPER DARBY TOWNSHIP, DELAWARE COUNTY, PENNSYLVANIA, FOR WORK ON, OR SERVICES PERFORMED OR RENDERED IN SAID TOWNSHIP, REQUIRING THE FILING OF DECLARATIONS AND RETURNS, AND THE GIVING OF INFORMATION BY EMPLOYERS AND OTHERS SUBJECT TO THE TAX, IMPOSING ON EMPLOYERS THE DUTY OF COLLECTING THE TAX AT THE SOURCE, PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF THE ORDINANCE AND IMPOSING PENALTIES FOR VIOLATION THEREOF; PROVIDING FOR A SEVERABILITY CLAUSE; REPEALING ALL INCONSISTENT ORDINANCES OR PARTS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE The Home Rule Charter and Optional Plans Law, 53 Pa. C.S. §2901 et seq., provides that a municipality which has adopted a home rule charter shall have the power to enact and enforce local tax ordinances pursuant to the Local Tax Enabling Act to levy, among other things, an earned income tax. Proposed Ordinance No. 3191 will, inter alia, impose an Earned Income Tax on all income earned by all residents and non-residents in the amount of one percent (1.00%) under the authority of the Local Tax Enabling Act, 53 P.S. §§ 6924.101, et seq., establishes exemptions to the earned income tax, establishes rules and regulations for the collection and enforcement of the earned income tax, sets forth an effective date of the Ordinance along with an imposition and collection date commencing on January 1, 2026 for the earned income tax, establishes article and section numbers of the ordinance, and repeals all inconsistent ordinances, all as further outlined in the Ordinance. It is the judgment of the Upper Darby Township Council, the Upper Darby Township Mayor and the Upper Darby Township Chief Administrative Officer, individually and collectively, that the earned income tax is necessary to offset the very great need to raise additional revenues for the General Fund of the Township and in order to hopefully avoid any necessity for raising Real Estate Taxes; and, for the further reason that economic projections indicate that the Township will enter into a deficit without increases in tax revenues. The amount of revenue estimated to be derived from this earned income tax is approximately $17,800,000.00.
