PLEASE TAKE NOTICE that Anthony Bertucci (the “Applicant”) has applied to the Hopewell Township Zoning Board of Adjustment (“Board”) for preliminary and final major subdivision approval, variance relief, checklist waivers, design waivers, and related approvals in connection with the property located at 203 Penn View Drive, Pennington (Hopewell Township), Mercer County, New Jersey, and designated as Block 46.06, Lots 2 and 3 on the Hopewell Township Tax Map (the “Property”). The Applicant seeks approval to subdivide and/or confirm the separate development of existing Tax Lots 2 and 3 as two legal residential lots. Each lot contains approximately 28,816 square feet of lot area and approximately 136 feet of frontage on Penn View Drive. Existing Lot 2 is improved with a single-family dwelling. Existing Lot 3 is vacant and is proposed to be improved with a new single-family dwelling, together with related site improvements, including driveway, patio, walkway, utilities, septic system, well, grading, drainage, and stormwater management features. The Property is located in the R-100 Well and/or Septic Zoning District of Hopewell Township’s Land Development Ordinance and also within Zone B of the Delaware and Raritan Canal Commission review zone. There are no environmentally sensitive areas on the Property. Existing Tax Lots 2 and 3 were created as part of the Penn View Heights subdivision and, while initially compliant with zoning, are undersized under the current R-100 zoning standards. The application therefore seeks bulk variance relief pursuant to N.J.S.A. 40:55D-70(c)(1) and/or N.J.S.A. 40:55D-70(c)(2), as applicable, for existing and proposed lot area, lot width, and lot depth conditions; for the existing side-yard setback and lot-coverage conditions on Lot 2, to the extent relief is required, and for the proposed side-yard setback condition on Lot 3, to the extent relief is required. The Ordinance requires a minimum lot area of 80,000 square feet, whereas the proposed lot areas are 25,816 square feet for Lot 2 and 25,816 square feet for Lot 3. The Ordinance requires a minimum lot width of 150 feet, whereas the proposed lot widths are 138 feet for Lot 2 and 136 feet for Lot 3. The Ordinance requires a minimum lot depth of 200 feet, whereas the proposed lot depth for each of Lots 2 and 3 is 197.18 feet. The Ordinance requires a minimum side-yard setback of 40 feet, whereas a proposed side-yard setbacksfor Lot 2 is 20.3 feet and a proposed side-yard setback for Lot 3 is 29 feet . The Applicant also seeks a density variance pursuant to N.J.S.A. 40:55D-70(d)(5), to the extent required, because the proposed subdivision would permit two residential lots where the current R-100 lot-area standards would otherwise require a larger tract area . The Ordinance permits a maximum density of 0.5 units per acre, whereas the proposed density is 1.82 units per acre for Lot 2 and 1.82 units per acre for Lot 3. The Applicant will present testimony that the requested density relief is appropriate because the lots were originally created as part of a plan entitled “Final Plan Section No. III, Penn View Heights”, such that the proposed two-lot residential subdivision proposal is consistent with the established development pattern in the surrounding neighborhood of Penn View Heights, thus permitting single-family residential use consistent with the surrounding single family development without creating a substantial detriment to the public good or a substantial impairment of the intent and purpose of the zone plan and zoning ordinance. The Applicant shall also seek any checklist waivers, design waivers, exceptions, interpretations, variances, approvals, or other relief that the Board and/or its professionals may determine to be necessary or appropriate in connection with this application, including any relief necessary for existing nonconforming conditions, proposed improvements, or conditions shown on the submitted plans and application materials.
