NOTICE OF DECISION PLEASE TAKE NOTICE that on March 26, 2026, the Township of Hopewell Planning Board (the “Board”) adopted a resolution (the “Resolution”) memorializing its decision granting the application of U.S. Home, LLC (dba Lennar) (“Applicant”) for preliminary and final major subdivision approval, and preliminary and final major site plan approval with bulk (c) variance, design waiver/exception relief and de minimis exceptions from the New Jersey Residential Site Improvement Standards (“RSIS”) (the “Application”), with respect to property located at 61 Nursery Road, 137 Nursery Road, Scotch Road (aka County Route 611) and Nursery Road (aka County Route 647), Hopewell Township, Mercer County, New Jersey, the same of which is designated as Block 93, Lots 19, 19 Q0091, 20 Q0091, 45.01, 46 and 60 Q0091 on the official Tax Map and Tax Duplicate of the Township of Hopewell (the “Property”). The Board approved Applicant’s Application to: (1) develop the Property with a 594-unit age restricted inclusionary residential development consisting of 272 to 274 single family detached homes, 110 to 112 single-family semi attached (“duplex”) residential units, 90 condominium units (“stacked flats”) located within nine (9) separate multifamily buildings and 120 affordable housing units (“stacked flats”) within twelve (12) separate multifamily buildings, for a total of no more than 594 units (including 120 affordable units and a maximum of 474 market rate units and a minimum of 472 market rate units); (2) construct associated site improvements and community amenities, including but not limited to parking areas, stormwater management, utilities, signage, landscaping, lighting, a clubhouse, pool and other outdoor recreational amenities as shown on the approved plans, which may be further amended from time to time without further notice; and (3) construct off-tract improvements to Nursery Road (aka County Route 647). As part of the Application, Applicant obtained preliminary and final major subdivision approval to subdivide the Property into up to 423 total lots consisting of: 272 to 274 single family home lots ranging from approximately 6,050 square feet (“SF”) to approximately 21,819 square feet; 9 lots ranging from approximately 14,707 SF to approximately 18,248 SF to each contain one condominium building; 12 lots ranging from approximately 10,388 SF to approximately 10,707 SF to each contain one apartment building; 110 to 112 duplex lots ranging from approximately 4,675 SF to approximately 12,893 square feet and 17 lots to serve as open space and/or contain infrastructure or community amenities to serve the development. As part of the Application, the Board approved the following bulk (c) variance, design waiver/exception relief and de minimis exceptions from RSIS, including: (1) to permit granite block curb, both vertical and mountable, where concrete curb is required; (2) to permit HDPE pipe within rights-of-way to be dedicated to Hopewell Township; (3) to permit driveways grade of up to 7% in certain locations whereas a maximum grade of 5% is permitted; (4) to permit disturbance of steep slopes greater than 25% where same is not permitted (29.8% disturbance), and to permit 29.2% disturbance to slopes between 15% and 25% whereas 15% disturbance is permitted; (5) to permit sidewalks in some locations of the Property on one side of the street whereas RSIS requires sidewalk on both sides of the street, (6) to permit more than the maximum number of homes within a single block; (7) to permit less than the required landscaped area of the clubhouse parking lot and relief from providing 6 foot wide planted beds in parking area; (8) relief from providing depressed grading areas in parking lot planting areas; (9) to permit a sales trailer with temporary signage; and (10) to permit up to 8 ft. fencing in the southeast corner of the Property whereas 6 ft. is permitted. The Resolution has been filed with and is available for public inspection at the office of the Board, which is located at the Office of Community Development, Hopewell Township Municipal Building, 201 Washington Crossing Pennington Road, Titusville, New Jersey 08560, during regular business hours.
