LEGAL NOTICE Notice is hereby given that Phoenixville Borough (hereinafter the “Borough” or the “Owner”) will accept sealed proposals for the Paradise Street Improvement Project on SR 0023 Nutt Road in Phoenixville Borough, Chester County, PA. Bids will be accepted electronically until 11:00 AM, prevailing time, April 8, 2026, via PennBid (https://pennbid.bonfirehub.com/) only. Plans and specifications are available online at no charge via PennBid https://pennbid.bonfirehub.com/. Questions must be submitted via PennBid by April 1, 2026, at 12:00 PM prevailing time. All proposals (bids) are to be accompanied by a bid bond or certified check in the amount of 10% of the total bid. The Borough reserves the right to waive any minor informalities, irregularities or defects in the bid; or to reject any or all of the bids. The work indicated will be funded in part by the Chester County Department of Community Development with partial reimbursement under the Community Development Block Grant Program. The solicitation process, contract and conduct of the work must meet the requirements of the grant agreement between the Owner and the County. The agreement obligates the Owner to certain compliance requirements that, if not fulfilled, may cause the Owner to forfeit the grant proceeds. Bids are to be submitted on the forms furnished in the bid package. All bidders must be qualified to perform the work and shall complete the required Bidder Forms contained in the contract documents. All bids and bid prices shall be in accordance with the federal Davis Bacon Prevailing Wage Act, and the successful bidder shall pay no less than the Davis Bacon Wage Rates determined for the project as stated in the Contract Documents. Award of the Contract, if the contract is awarded, will be to the lowest responsible bidder, however Owner reserves the right to reject any and or all bids on any basis and to waive any informality in the bidding, as permitted by law. This bid is also in accordance with HUD Section 3 Workforce requirements and the 2021 Build America, Buy American Act (BABA). All bidders are required to establish proof of competency and responsibility, in accordance with 67 PA Code Chapter 457, Regulations Governing Pre-qualification of Prospective Bidders and PennDOT Form 408/2020, as supplemented and amended, Section 102. Subcontractors must pre-qualify in the same manner, if listed in the proposal or if bidder subsequently undertakes the partial or total construction of one or more items of work. All bidders and subcontractors must be PennDOT pre-qualified for the items of work they are to perform. Any bidder to be acting as the primary Contractor must be PennDOT pre-qualified as the same. E.
