BOROUGH OF DARBY DELAWARE COUNTY, PENNSYLVANIA NOTICE IS HEREBY GIVEN that the Borough Council of the Borough of Darby, Delaware County, Pennsylvania, will consider for adoption the following proposed ordinance at its regularly scheduled public meeting to be held on Wednesday, July 15, 2026, at 7:00 p.m., at Darby Borough Hall, 1020 Ridge Avenue, Darby, Pennsylvania 19023. AN ORDINANCE OF THE BOROUGH OF DARBY, DELAWARE COUNTY, PENNSYLVANIA, ENACTED PURSUANT TO THE PENNSYLVANIA BOROUGH CODE, THE PENNSYLVANIA MUNICIPALITIES PLANNING CODE, AND THE POLICE POWERS OF THE BOROUGH; ESTABLISHING A COMPREHENSIVE NON-RESIDENTIAL OCCUPANCY PERMIT PROGRAM GOVERNING THE OCCUPANCY, USE, TRANSFER, AND OPERATION OF NON-RESIDENTIAL PROPERTIES WITHIN THE BOROUGH; AUTHORIZING THE BOROUGH MANAGER TO ADMINISTER AND ISSUE NON-RESIDENTIAL OCCUPANCY PERMITS CONSISTENT WITH THE BOROUGH ZONING ORDINANCE, BUILDING CODES, PROPERTY MAINTENANCE REGULATIONS, FIRE SAFETY REQUIREMENTS, AND OTHER APPLICABLE LAWS; ESTABLISHING APPLICATION, INSPECTION, ENFORCEMENT, REVOCATION, APPEAL, AND PENALTY PROVISIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT THEREWITH; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. The proposed ordinance establishes a comprehensive administrative process requiring a Non-Residential Occupancy Permit prior to the occupancy or operation of commercial and other non-residential properties within the Borough. The ordinance authorizes the Borough Manager to administer and issue permits upon determining compliance with the Borough Zoning Ordinance and all applicable building, fire, property maintenance, and other municipal code requirements. The ordinance further establishes application procedures, inspection requirements, enforcement mechanisms, permit suspension and revocation procedures, appeals, penalties for violations, and related administrative provisions. A complete copy of the proposed ordinance is available for public inspection during normal business hours at the Office of the Borough Secretary, Darby Borough Hall, 1020 Ridge Avenue, Darby, Pennsylvania 19023, and may be examined by any interested person prior to the meeting. Copies may also be obtained upon payment of applicable duplication costs. At the time and place stated above, Borough Council will receive public comment on the proposed ordinance before taking such action as it deems appropriate.
